Refund policy
Refund and Returns Policy (Wholesale)
drinkware (drinkwarehq.com) Effective date: November 2, 2026 | Last updated: November 2, 2026 | Version: 1.2
This policy applies to wholesale purchases from Yongkang Qianya Hardware Products Factory (永康市千雅五金制品厂), an individually owned business (individual industrial and commercial household, 个体工商户) registered in the People's Republic of China under unified social credit code 92330784MAKM1N1Q0Y, with its registered address at Room 3 (third from the east), 5th Floor, No. 73 Qianjin Road, Zhiying No. 7 Village, Zhiying Town, Yongkang, Jinhua, Zhejiang 321306, China ("we", "us") by business buyers ("Buyer", "you"). It forms part of our Terms of Service and Wholesale Terms of Sale (the "Terms"). If this policy conflicts with your proforma invoice ("PI"), the PI prevails.
Because we sell only to businesses, consumer rights of withdrawal or "cooling-off" periods do not apply.
1. No Returns for Change of Mind
Products that conform to the PI and the agreed specifications cannot be returned, exchanged or refunded for reasons such as change of mind, slow sales, overstock or changes in the Buyer's market.
2. Customized Products, Including Stock Products with Your Logo, Are Non-Refundable
Products made to your specifications are made to order and cannot be canceled, returned or refunded once production has started, except where they are defective under Section 3. This includes:
- products bearing your logo or artwork, applied by any decoration method (including laser engraving, screen printing, heat transfer and UV printing), including stock products with your logo;
- custom colors, coatings or finishes;
- custom packaging; and
- OEM designs.
Advance payments for customized orders, including stock products with your logo. When we receive your advance payment for a customized order, we commit it to materials, set-up and tooling, and production scheduling for products made to your specifications, which cannot reasonably be resold. If you cancel a customized order at any time after paying the advance payment, the advance payment is non-refundable (see Section 6.1A of the Terms). A stock product with your logo, applied by any decoration method, counts as a customized order, not a stock order, so the advance payment for it is non-refundable once paid. If an order for stock products with no logo and no other customization is canceled, we will refund the advance payment less the actual costs and losses we have incurred (see Sections 4.6 and 6.5 of the Terms). This does not apply where you cancel because of a delay on our side under Section 7.4 of the Terms, where the order is terminated under Section 15 of the Terms, or where the cancellation results from our breach. An advance payment is part payment of the price and is not earnest money.
3. Defective, Non-Conforming or Short-Shipped Products
3.1 What counts as a valid claim
You may claim if Products do not conform to the PI, the approved sample or the agreed specifications, or are defective in materials or workmanship. Examples include:
- separation, denting or other defects in the double-wall construction;
- leaking lids;
- damaged coating;
- incorrect printing; and
- quantity shortage.
Where a lot is assessed by sampling, a lot that meets the AQL stated in the PI (AQL 2.5 unless the PI states otherwise) is accepted as a lot. This does not apply to defects that make a product unsafe, and it does not affect your other rights under Section 9 of the Terms.
3.2 Claim deadlines
| Type of issue | Deadline for written notice |
|---|---|
| Shortage, visible damage or visible defects | Within 14 days after the goods arrive at the destination port or place |
| Latent defects (not discoverable on reasonable inspection) | Within 30 days after discovery, and in any event within the warranty period of 12 months from delivery |
Claims made after these deadlines will not be accepted.
3.3 Evidence required
Send your claim to sales@drinkwarehq.com with:
- the PI number and order date;
- the product SKU, batch or lot number (printed on the product or carton) and the quantity affected;
- clear photographs or video of the defect and of the carton markings;
- for leak defects, a short description of how the product was tested (for example, filling the product with water and turning it upside down);
- for quantity shortages, the packing list, the carton count on arrival, and the delivery receipt noting the shortage;
- for transit damage, the carrier's delivery receipt noting the damage and, if available, a surveyor's report; and
- any third-party inspection or laboratory report you rely on.
We may ask for representative samples to be sent to us, or to an independent inspection company, for verification. Please do not discard defective goods until your claim is resolved.
3.4 How we resolve valid claims
For confirmed claims, we will provide remedies in the following order:
- Replacement: ship replacement products free of charge, normally with your next order or by the most economical shipping method;
- Repair or rework: repair the products, or reimburse reasonable rework costs that we have approved in advance in writing;
- Credit: issue a credit note for the value of the non-conforming products, to be applied against your next order; and
- Refund: only if none of the above is reasonably practicable, refund the price paid for the non-conforming products.
Our liability for any claim is limited as set out in the Terms, including the limitation of liability in Section 11 of the Terms.
3.5 Returns of defective goods
Do not return goods without a written Return Authorization (RA) number from us. Where we request a return, we will agree the return method and bear the reasonable return freight for confirmed defective goods. Goods must be shipped back within the period stated in the RA. For low-value defects, we may instead ask you to destroy the goods and send photographic evidence of destruction.
4. Transit Loss or Damage
Unless otherwise agreed in writing in the PI, our sales are FOB Ningbo, China (Incoterms® 2020), and risk passes to you when the goods are on board the vessel at Ningbo port. Under any other Incoterms® rule agreed in writing in the PI, risk passes as provided in that rule. Claims for loss or damage after risk has passed should be made against your carrier or cargo insurer. We will provide reasonable documentation to support your claim.
5. Samples
5.1 Sample fees. Samples are charged. The sample fee is quoted for each sample request in a sample quotation or sample invoice. Courier costs are paid by you. Custom samples bearing a logo also carry the setup fee described in Section 4.5(e) of our Terms, in the amount shown in the sample quotation.
5.2 Deduction from the bulk order balance. If, within one hundred and eighty days after the date of the sample invoice, you place a bulk order for the same item(s) as the samples, the sample fee you paid for those items is deducted once from the 70% balance payment for that bulk order, provided the bulk order matches the approved sample in style, logo and color; otherwise it is not deducted. Where the PI for the bulk order provides for payment terms other than a 30% advance payment and a 70% balance, the PI states how the sample fee is deducted. Courier costs are not refunded or deducted. Setup fees are not refunded; where you have paid the setup fee for a custom sample, no setup fee is charged again for the same logo in the same position on your first bulk order with that logo in that position; reorders follow Section 4.5(e) of our Terms. Each sample fee can be deducted only once and has no cash value.
5.3 Sample lead times. Sample lead times are estimates only and are counted in business days (Beijing time, UTC+8, excluding Chinese public holidays). Stock samples are usually dispatched within 3–5 business days, starting on the business day after we receive the full sample fee. Custom sample lead time (5–7 business days) is counted from the business day after we receive your sample payment (the sample fee and any setup fee) or after you approve the sample artwork, whichever is later.
5.4 Samples damaged or defective on arrival. You must notify us in writing, with photographs, of any sample that is damaged or defective on arrival within 7 days of receipt. Samples for which no notice is received within 7 days of receipt are treated as accepted in good condition. If you notify us in time and we confirm the damage or defect, we will replace the affected sample free of charge and pay the courier cost for sending the replacement. Apart from Sections 5.2 and 5.4, samples are provided for evaluation only and are non-refundable and non-returnable.
5.5 Approved samples set the standard. Once you approve a pre-production sample in writing, it becomes the quality standard for the bulk order.
5.6 Customs on samples. Duties and taxes on samples in your country are payable by you as the importer.
6. Payment of Refunds and Credits
Refunds are paid in USD by bank transfer to the account from which payment was received, within 30 days after the claim is confirmed and the refund amount is agreed in writing. Where a refund results from our own cause (for example, our breach of the Contract, a delay of more than 60 days under Section 7.4 of the Terms, or defective or non-conforming products under Section 9.4 of the Terms or Section 3 of this policy), we bear the bank charges for sending it. In all other cases, the bank charges for sending a refund, including the charges of the sending bank and of any intermediary or correspondent bank, are borne by you, and the refund is sent net of those charges. Credit notes are valid for 12 months and have no cash value.
