Shipping Policy (Wholesale)

drinkware (drinkwarehq.com) Effective date: November 2, 2026 | Last updated: November 2, 2026 | Version: 1.5

This policy applies to wholesale orders from Yongkang Qianya Hardware Products Factory (永康市千雅五金制品厂), an individually owned business (individual industrial and commercial household, 个体工商户) registered in the People's Republic of China under unified social credit code 92330784MAKM1N1Q0Y, with its registered address at Room 3 (third from the east), 5th Floor, No. 73 Qianjin Road, Zhiying No. 7 Village, Zhiying Town, Yongkang, Jinhua, Zhejiang 321306, China ("we", "us") and forms part of our Terms of Service and Wholesale Terms of Sale. If this policy conflicts with your proforma invoice ("PI"), the PI prevails.

1. Delivery Terms (Incoterms® 2020)

All sales are FOB Ningbo, China (Incoterms® 2020) unless otherwise agreed in writing in the PI.

Term Destinations Delivery and transfer of risk
FOB Ningbo, China All destinations, including Saudi Arabia (port of destination: Jeddah) and the United Arab Emirates (port of destination: Khor Fakkan). You or your forwarder book the vessel. Risk passes to you when the goods are on board the vessel you nominate at Ningbo port. We handle export customs clearance and delivery to the vessel.

Any other Incoterms® 2020 rule (for example CFR, CIF, CPT, CIP or DAP) applies only where it is agreed in writing in the PI, together with the named place.

2. Freight Is Quoted Separately

Product prices do not include international freight, insurance or destination charges. You may:

  • (a) use your own freight forwarder (under FOB Ningbo, you or your forwarder book the vessel); or
  • (b) ask us to obtain a freight quotation. Any freight we arrange is quoted separately, is valid only for the period stated, and may be adjusted for carrier surcharges, port fees or rate changes before booking, as provided in Section 5 of the Terms.

3. Lead Times Are Estimates

Production lead times and shipping dates given in quotations, PIs, on the Site or in our emails, including those described as "usually" or "typically", are estimates only and are not guaranteed delivery dates. Unless your PI states otherwise, they run:

  • for stock items, from the business day after we receive the advance payment in cleared funds;
  • for stock items with a custom logo (by any decoration method, including laser engraving, screen printing, heat transfer and UV printing), from the business day after the later of: (i) our receipt of the advance payment in cleared funds; and (ii) your written approval of the logo proof; and
  • for custom items, from the business day after the latest of: (i) our receipt of the advance payment in cleared funds; (ii) your written approval of the final artwork; and (iii) your approval of the pre-production sample, where one is required.

During peak season or for large orders, the lead time is confirmed in your PI. Lead times are extended by any delay in payment or approvals, by changes you request, and by events outside our control (see Sections 7.4 and 15 of the Terms). Goods are shipped only after full payment has been received (see Section 6 of the Terms).

Transit times depend on carriers, ports, customs and events outside our control, for example port congestion, canal or strait closures, weather and inspections. We are not responsible for delays after the goods have been delivered under the agreed Incoterms® rule (under FOB Ningbo, once they are on board the vessel). We will inform you promptly of any expected production delay.

4. Import Clearance, Duties and Importer Obligations

Unless your PI expressly states DDP, you are the importer of record and are responsible for:

  • import customs clearance in the destination country, and appointing your customs broker;
  • all import duties, additional tariffs, anti-dumping duties, import VAT, GST or sales tax, customs fees and port charges;
  • importer registrations and customs bonds (for example US CBP Form 5106 and continuous or single-transaction bond, Canada CARM, EU or UK EORI); and
  • all local obligations of an importer or of the person placing products on the market. These include EU GPSR responsible-person duties, packaging and EPR registrations, and local-language labeling. In Saudi Arabia and the United Arab Emirates, they also include any commercial registration or import license required of the importer, conformity certificates and registrations such as Saudi SASO/SABER product and shipment certificates and UAE ECAS registration, the Gulf Conformity Mark (G-Mark) where a Gulf (GSO) technical regulation applies to the Products, and Arabic labeling.

Full details are in Section 10 of the Terms. Customs authorities may require additional product information. We will provide reasonable assistance, for example by supplying material composition, model numbers and copies of export declarations.

We do not guarantee that the Products will be cleared by customs in the country of import, that any certificate or registration will be granted, or the amount of any duties, tariffs or taxes. These are determined by the relevant authorities and may change.

5. DDP Only by Special Agreement

We ship on a Delivered Duty Paid (DDP) basis only where expressly agreed in a signed PI or written agreement. DDP prices are quoted case by case and may include additional charges for:

  • duties;
  • customs bonds;
  • brokerage;
  • local registrations; and
  • regulatory changes.

We do not offer DDP for deliveries to Saudi Arabia or the United Arab Emirates. For shipments to the United States, we do not generally act as importer of record.

6. Transfer of Risk and Title

  • Risk passes to you at the point stated in Section 1, in accordance with the agreed Incoterms® rule.
  • Title passes only when we have received full payment, as set out in Section 7.5 of the Terms.

7. Cargo Insurance

Under FOB terms, you are responsible for insuring the goods from the point at which risk passes to you, that is, once the goods are on board the vessel at Ningbo port. We strongly recommend all-risks marine cargo insurance, for example Institute Cargo Clauses (A).

Where CIF or CIP is agreed in writing in the PI, we will arrange insurance as required by Incoterms® 2020:

  • CIF: minimum cover under Institute Cargo Clauses (C); and
  • CIP: Institute Cargo Clauses (A).

In both cases cover is for 110% of the invoice value, unless otherwise agreed.

8. Shipping Documents

For each shipment we provide:

  • a commercial invoice;
  • a packing list showing cartons, quantities, net and gross weights and dimensions;
  • a certificate of origin, where requested. Indicate in your order if a specific form is required. Fees for chamber or legalized certificates may be charged at cost;
  • the bill of lading, air waybill or forwarder's cargo receipt, as applicable under the agreed term. Original documents are released after full payment of the balance; and
  • the compliance documents listed in the PI, for example test reports, declarations of compliance, and the product and economic-operator information required under the EU General Product Safety Regulation (GPSR).

All Products are permanently marked "Made in China". Please tell us before the PI is issued if your customs broker requires specific wording, HS code descriptions or additional documents. Documentary requirements in Saudi Arabia and the United Arab Emirates may include legalization or attestation of the certificate of origin or commercial invoice; please confirm these with your customs broker. Legalization and attestation fees may be charged at cost.

9. Packaging and Shipping Marks

Products are packed in export cartons suitable for ocean freight. Custom carton markings, labels or pallets must be specified in the PI and approved in writing before production.

10. Restricted Destinations

We do not ship to destinations, or to parties, where the shipment would breach applicable export control or sanctions laws (see Section 14 of the Terms).
